Speeding Tickets

If you receive a speeding ticket in the Outer Banks or elsewhere in northeastern North Carolina, you will need to appear in court to address the ticket OR have an attorney appear for you via Power of Attorney. If you fail to take care of your speeding ticket or citation, the Court will issue a failure to appear, which is a misdemeanor that can lead to serious consequences, including the indefinite revocation of your driver’s license.

Types of North Carolina Speeding Tickets

In North Carolina, you can receive a speeding ticket for operating a vehicle in excess of the posted speed limit or “at a speed greater than is reasonable and prudent under the conditions then existing.” This is a basic speeding ticket. It is a non-criminal violation of the law, i.e., an infraction.

However, there are several other speeding-related violations that you can be charged with in our state. A few of these are criminal offenses that carry the possibility of jail time.

Commonly issued violations are:

  • Driving too slowly (infraction)
  • Speeding in a school zone (infraction)
  • Speeding in a highway work zone (infraction)
  • Driving more than 15 mph above the speed limit or over 80 mph (Class 2 misdemeanor)
  • Unlawful highway racing (Class 1 or Class 2 misdemeanor depending on if it was “prearranged”)
  • Speeding to elude arrest (Class 1 misdemeanor or Class H felony depending on the presence of aggravating factors)
  • Aggressive driving (Class 1 misdemeanor)
  • Reckless driving (Class 2 misdemeanor).
Speeding Tickets, Your Driver’s License and Auto Insurance Premiums

If you are convicted of speeding in North Carolina, the N.C. Division of Motor Vehicles (DMV) will assign points to your driving record. If you compile 12 points or more in a three-year period, you could lose your license. If you compile eight points within three years of getting your license back, you could face another suspension.

Driving record points for common speeding and related violations are:

Additionally, you will be assessed insurance points. These points are counted differently than DMV points. The more points you compile within the three-year period prior to seeking new auto insurance or a renewal of your policy, the higher your insurance premiums will be.

The insurance points you can expect for common speeding violations, rate increases and costs (assuming a basic premium rate of $300 ) are:

In addition to those insurance points, insurance companies can also cede you to the risky driver’s group, i.e., reinsurance facility, which has the effect of then basically doubling the effects of the points assessed against you.

For instance, the consequences of a speeding ticket can be minimized by seeking:

  • Reduction to a lesser offense – Several factors, including a clean driving record, can help you to pursue a plea to a reduced speeding offense or a non-moving violation. As you can see above, getting a ticket reduced to 10 mph or less above the speed limit can mean a major difference in your insurance premiums. A non-moving violation carries no driving record or insurance points.
  • Prayer for Judgment Continued – Only one PJC per household can be obtained in a three-year period or two every five years. The violation would remain on your record, but it would not count towards your DMV or insurance points (as long as there is no other moving violation within a three-year period).

However, what they fail to understand is that neither the Prosecutor, nor the officer, nor the Clerk, nor the Judge is looking at your or your family’s driving record to make sure that “the deal” is in the your best interest. Officers and Court Personnel merely want to get a conviction and get your case over with. What they fail to say is that “the deal” can often result in really steep insurance increases, driver’s license points or revocations, or other unspoken consequences based upon your or your family’s prior tickets, accidents, points or driving records.
